Mohammed bin Rashid amends Law on the Establishment of Dubai Data Establishment

In his capacity as Ruler of Dubai, Vice President and Prime Minister of the UAE His Highness Sheikh Mohammed bin Rashid Al Maktoum issued Law No. (2) of 2020 partially amending Law No. (2) of 2016 on the Establishment of Dubai Data Establishment (DDE).

According to Article (7) of the new Law, the Director General of Smart Dubai  will be responsible for  general supervision  of the  operations  of  the  DDE  and the  delivery  of  its  functions  under  the  Law.  Towards this purpose, the Director General of Smart Dubai is authorised to approve and follow up on the implementation of DDE’s general policy and strategic and operational plans; approve its organisational structure, draft its annual budget and final accounts; and approve its projects, programmes and initiatives.

According to Article (9) of the Law, DDE   will   have   an   executive   body   comprised   of   the   CEO   and   administrative, financial, and technical employees. The executive body will be responsible for the operations, and  for  following  up  on the  implementation  of  the  resolutions issued by  the  Director General of Smart Dubai.

Article (10) of the new Law stipulates that DDE’s  CEO  will  be  appointed  pursuant  to  a  resolution  of  the  Chairman  of  The  Executive Council. The CEO will report to the Director General of Smart Dubai. The new Law also prescribes the duties and powers of the CEO.

With the exception of decisions issued by the Director General of Smart Dubai pursuant to this Law, the Chairman of The Executive Council of Dubai will issue all the resolutions required to implement this Law.

The new Law annuls any other legislation that contradicts or challenges its articles. The Law is valid from its date of issuance and will be published in the Official Gazette.
